DAYTON —

A driver arrested Friday afternoon after he tried to run from an accident he is accused of causing is the same man convicted in a July 2011 hit-and-run accident that resulted in the death of a 7-year-old girl.

Jas Presley, 21, was booked into the Montgomery County Jail just before 4 p.m. after police apprehended him in the 3700 block of Hoover Avenue.

According to police, Presley is believed to have been driving a car that crashed with another vehicle and then slammed into a house at Hoover and Osmond avenues just after 2 p.m.

Police said whoever was at the steering wheel was driving erratically prior to the crash.

The driver of the vehicle that was hit fled and apparently has not been located as of Friday night.

Police, checking the vehicle that hit the house, found a firearm.

Online jail records make no mention of a firearm-related charge, but Presley was booked in on single counts of misdemeanor obstructing official police business and felony failure to comply with the order of a police officer.

Last October, Presley was convicted at a bench trial on one count of failure to stop after an accident. Montgomery County Common Pleas Judge Gregory Singer, who saw the evidence and heard witness testimony, sentenced Presley to five years community control and suspended his driver’s license for six months.

According to that court order, Presley’s license suspension is scheduled to end sometime in April.

Presley was driving a PT Cruiser that struck 7-year-old Robbie Carter on the night of July 4, 2011, as she was crossing Nicholas Road with a group of people, according to police.

The child died at Miami Valley Hospital less than an hour later.

Police identified the driver as Presley and jail records indicated he was arrested for leaving the scene of an accident.

At the time, Dayton Lt. Wendy Stiver said the driver called the county regional dispatch center a short time after the accident and made police aware of his location. Police said he cooperated with traffic investigators.
