DAYTON —

A man who was shot and killed on East Third Street early Thursday morning had an extensive history of run-ins with police in that part of town.

Police said Michael E. Neibert, 41, was killed around 2 a.m. at a duplex at 3723 E. Third.

According to family members, Neibert was visiting his mother who lives on one side of the duplex and went over to the other half where some sort of argument ensued with the two people inside.

Police radio traffic indicated that one of the men inside the duplex called 911 at about 1:58 a.m. and said someone had broken a window and his friend had fired shots through the back door. When police arrived to investigate they discovered Neibert lying shot between two houses. They called for an ambulance at 2:09 a.m.

Neibert’s friends and family said he was sometimes hostile and was possibly arguing with the men about a TV that was stolen from one of them earlier in the evening.

“He just gets loud and wants to argue. He would have walked away,” said friend Darrell Hall. “It wasn’t nothing for them to have to shoot him for.”

Ciara Goff said her stepfather, who went by Mikey, has lived down the street and was well known in the neighborhood. “Everybody knows Mikey, they know how he is,” she said.

Police have not confirmed any details of the crime other than that there were two people inside the residence when Neibert was shot and they are questioning multiple people with knowledge of the incident.

Police are looking at the possibility that Neibert broke into the home Wednesday evening and returned early Thursday. Radio traffic indicates that police were at the address Wednesday at about 9:30 p.m. to take a burglary report.

Neibert’s criminal record includes 35 criminal arrests since 1992, according to Dayton Municipal Court records. Offenses he was accused of included domestic violence, assault and disorderly conduct. He had felony convictions for violating a protection order, theft and robbery.
