DAYTON —

A man questioned by police Monday evening denied soliciting a prostitute, but admitted to having marijuana in his car, according to a Dayton Police report.

Officers monitoring prostitution activity on E. Third Street spotted a known prostitute get into vehicle with a male driver. Officers followed the car and saw the woman lean down as if performing a sex act on the man.

When an officer approached the car, the woman sat up and the male driver attempted to drive away. He made it about 100 feet before he was blocked into an alley by an unmarked police vehicle.

The man, identified as Donald Shepherd, 31, said they were not engaged in a sex act, but rather that they were about to smoke some marijuana. Police recovered a small baggie of pot from the car and cited Shepherd for drug possession.

He has several prior drug convictions according to Dayton Municipal Court records.

According to the police report, the woman, Danielle Masters, 24, admitted to police that she was performing a sex act on Shepherd in exchange for $20. The cash was found in an ashtray in the car.

The report states that Shepherd’s wife arrived on the scene of the arrests, which was behind his home on North Sperling.

Shepherd and Masters could both be charged with public indecency, soliciting, loitering to engage in solicitation, and prostitution.

Shepherd could also be charged with failure to comply with the orders of a police officer.

Masters has several prior criminal convictions in Dayton including public intoxication, loitering to engage in prostitution, disorderly conduct and assault.
