Miami Twp. trustees are expected to review the internal investigation of the township’s deputy chief and consider possible disciplinary action at a hearing scheduled for Wednesday.

The review of an investigation into actions by Maj. John DiPietro originally was scheduled for last week. It was postponed because of his “current physical and medical condition,” according to a letter sent by his attorney.

DiPietro was placed on paid administrative leave in mid-October after two months of investigation into the decontamination of a 17-year-old girl who had been pepper-sprayed, Chief Chris Krug said in October.

The Montgomery County Sheriff’s Office completed an internal affairs investigation of DiPietro and sent it to township officials, Sheriff Phil Plummer said. Township officials had requested the investigation.

An exclusive News Center 7 and a Dayton Daily News investigation looked in to reports of DiPietro’s actions.

The incident in question occurred July 12, when the girl and a woman were arrested on suspicion of stealing clothes from Plato’s Closet on Springboro Pike.

The girl allegedly resisted arrest and was pepper-sprayed by an officer.

Plummer said DiPietro conducted the decontamination of the girl. He was alone with her as she was naked and sprayed her down with a water hose, Plummer said.

Krug has said DiPietro’s actions may have violated the police department’s policies and procedures.

The Montgomery County Prosecutor’s Office declined to file criminal charges against DiPietro.
