DAYTON —
A 20-year-old Dayton man accused of sexually assaulting a sleeping woman is now charged with two felony counts of sexual battery.
A Montgomery County grand jury returned the indictment against Douglas Cook on those charges Thursday, and declined to return a true bill on a charge of rape.
Cook was arrested after police said their investigation revealed that he had been spending the night at the victim’s house at the time of the incident. There were several other people there as well, police said.
Some of those people stopped the assault and called police, according to investigators.
