DAYTON —

A man who police said they observed buying marijuana Monday upped his possible charges from a minor misdemeanor citation to multiple misdemeanor offenses when he allegedly warned his dealer that the cops were after him.

According to a Dayton Police incident report, 20-year-old Keith Ely was seen purchasing a small amount of drugs from another man at the corner of Main and Third streets in downtown Dayton Monday afternoon.

Ely told police that he paid the other guy $5 for 1.8 grams for marijuana, according to the report. He was issued a minor misdemeanor citation for possession of marijuana and let go.

Officers then returned to Main and Third to try and locate the dealer, but instead saw that Ely had returned to the corner. When they eventually located the suspected dealer, he did not have any drugs on him. He said that Ely had come back and warned him about the cops.

Ely was located nearby and placed under arrest pending charges of prohibited substance solicitation and obstruction of official business. He was booked into the Montgomery County Jail at 2 p.m. and his bond has been set at $1,500.

Police did not have grounds to arrest the alleged dealer, but according to court records that man has prior felony convictions for trafficking in marijuana, trafficking in cocaine, and drug possession.
