Man admits to stealing $800 worth of tools

DAYTON —

A 20-year-old man was arrested on McClure Street in Dayton after he admitted to stealing close to $900 worth of tools.

Police responded to the 100 block of McClure around 3 a.m. Friday. The homeowner told police someone had been in his garage. An officer in the area saw a man wearing all black and running into a nearby alley. According to a Dayton police report, the officer said the man was given away because something he was carrying — the officer said it was some sort of light from a phone of flashlight.

Dayton officers found the man inside a vacant home on Boltin Street.

The suspect, Nicholas Henry, admitted to taking the property and said he dropped it off at a park on McReynolds Street. The stolen items included a propane lantern, saber saw, electric circular saw and assorted hand tools.

Everything was returned to the homeowner.

It was discovered that Henry was wanted on several warrants, including unlawful sexual conduct with a minor. He remains in the Montgomery County Jail on three counts of unlawful sexual conduct with a minor, misdemeanor assault and felony breaking and entering.

The unlawful sexual conduct accusations stem from a relationship that began in 2011 with a girl who was 14 years old at the time, according to Dayton police Sgt. Larry Tolpin.

Henry was 20 at the time, according to Tolpin.

“At 14, the state of Ohio does not recognize the ability to consent to sexual relations,” he said. “However, in her mind, she consented … It was not a ‘forcible’ issue.”

Tolpin said the girl’s parents became aware of the relationship after she contracted a sexually transmitted disease. The disease was not life-threatening.

Tolpin said Henry’s case was bound over to a grand jury.
