A 21-year-old man, arrested on a charge accusing him of having sex with a 13-year-old girl after the girl’s mom locked him in the basement of her home, remains in the Montgomery County Jail.

Bond for Shaquille Benjamin Passmore, who allegedly met the child via social media, has been set at $100,000, according to jail records. He’s charged with one count of felony unlawful sexual conduct with a minor and his next court appearance is Nov. 30.

Passmore was arrested at about 6 a.m. Wednesday on Kenwood Avenue, Dayton police Sgt. Larry Tolpin said, about four hours after the teenager’s mom and boyfriend left her alone the house.

They left to deal with a family emergency, Tolpin said.

The 13-year-old called Passmore, according to Tolpin. The two met through social media and had met in person before that.

According to the investigation, Passmore was invited to the residence, where the sexual activity took place. Shortly before 6 a.m., the teenager’s guardians returned and Passmore

ended up in the basement, likely thinking the basement door was a way out of the home.

The mother locked Passmore in the basement and called police.

Passmore said he had consensual sex with the girl, according to Tolpin. Ohio law states teenagers ages 13 to 16 are unable to consent to sexual activity, but the state believes they do have a certain degree of sexual understanding.

At 16, the state recognizes that most have the understanding to consent to sex, according to Tolpin.

“We’ve got a 21-year-old man engaging in sexual activity with a 13-year-old,” Tolpin said. “That’s obviously not right. I think he recognized that, but it was too late.”
