CLARK COUNTY —
An Enon man accused of setting a fire in a transitional-care facility that resulted in the death of a woman has been ordered to undergo a psychological evaluation.
Cody Sutton accepted a plea agreement earlier this month that allowed him to admit to a lesser charge of involuntary manslaughter. He had been facing one count of murder and two counts of arson in the death of Kathleen Hart, 89.
Sutton admitted to setting a fire in a storage room at Dayspring of Miami Valley, 8001 Dayton-Springfield Road, on Nov. 25, 2011, according to records. Hart suffered a cardiac episode during the evacuation, police said. She died at Miami Valley Hospital.
Sutton was scheduled to be sentenced today, but because he could not explain to the judge why he set the fire, a psychological evaluation was ordered.
It will take about six weeks to complete the evaluation and receive the results, according to Sutton’s attorney.
